Der Lokomotiv, Cycling Adventures wants to ensure that relationships with our customers run as smoothly as possible. We appreciate the trust you place in us and take your rights very seriously. With our sales conditions below, we want to give you a clear overview of your rights, and sometimes obligations. If something is not clear, we would appreciate it if you tell us.

By placing an order you indicate that you agree with the event / delivery and payment conditions. Der Lokomotiv reserves the right to change its event, delivery and / or payment conditions

Unless otherwise agreed in writing, the general or specific terms or conditions of third parties are not made by Der Lokomotiv

Der Lokomotiv guarantees that delivered products and services meet the agreement and meet the specifications stated in the offer

Prices

Our Prices will not be increased within the term of the offer, unless legal measures make this necessary or if the manufacturer implements interim price increases.

All prices on the site are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors.

All prices on the site are in Euros and include VAT

Offers

Offers are without obligation, unless stated otherwise in the offer.

If a non-binding offer is accepted by the buyer, Der Lokomotiv reserves the right to withdraw or deviate from the offer within 3 working days after receipt of that acceptance.

Oral commitments only bind Der Lokomotiv after they have been explicitly confirmed in writing.

Der Lokomotiv offers do not automatically apply to repeat orders.

Der Lokomotiv cannot be held to its offer if the customer should have understood that the offer, or any part thereof, contained an obvious mistake or clerical error.

Additions, changes and / or further agreements are only effective if agreed in writing.

Invoice

Shortly after submiting your order, you will be notified about your purchase via email from our email address info@derlokomotiv.com. You will always receive full commercial invoice together with your shipment.

Please note that the invoice is not an event ticket. This will also be sent to you immediately after payment in a separate email.

Subscription

By manually subscribing to the Newsletter of Der Lokomotiv, Cycling Adventures you agree to receive promotional inofmation from Der Lokomotiv to your email address. You can unsubscribe from receiving this newsletter any time by clicking ”unsubscribe” in the lower part of each newsletter sent by Der Lokomotiv.

Agreement

An agreement between Der Lokomotiv and a customer is concluded after an order assignment by Der Lokomotiv has been assessed for feasibility.

Der Lokomotiv reserves the right, without giving reasons, not to accept orders or to accept only under the condition that the event / shipment takes place after prepayment.

Pictures and specifications

All images, photos, drawings, specifications, … on the internet site of Der Lokomotiv are only approximate, are indicative and cannot give rise to compensation or termination of the agreement.

Force of the majority

Der Lokomotiv is not liable if and insofar as its obligations cannot be met due to force majeure.

Force majeure means any strange cause, as well as any circumstance, which should not reasonably be at its risk. Delays or defaults by our suppliers, disruptions in the Internet, disruptions in electricity, disruptions in e-mail traffic and disruptions or changes in technology provided by third parties, transport difficulties, strikes, government measures, delays in supply, supplier negligence and / or manufacturers of Der Lokomotiv as well as auxiliary persons, illness of personnel, defects in auxiliary or transport equipment are expressly regarded as force majeure.

In the event of force majeure, Der Lokomotiv reserves the right to suspend its obligations and is also entitled to dissolve the agreement in whole or in part, or to demand that the content of the agreement be changed in such a way that execution remains possible. Under no circumstances is Der Lokomotiv obliged to pay any fine or compensation.

If Der Lokomotiv has already partially fulfilled its obligations upon the commencement of the force majeure, or can only partially fulfill its obligations, it is entitled to invoice the already delivered or the deliverable part separately and the customer is obliged to pay this invoice as a separate contract. However, this does not apply if the already delivered or deliverable part has no independent value.

Liability

Der Lokomotiv is not liable for damage to vehicles or other objects caused by incorrect use of the products. Read the instructions on the packaging and / or consult our website before use.

Retention of title

Ownership of all goods sold and delivered by Der Lokomotiv to the customer remains with Der Lokomotiv as long as the customer has not paid Der Lokomotiv’s claims under the agreement or earlier or later similar agreements, as long as the customer has performed or is yet to perform the work from these or similar agreements and as long as the customer has not yet paid Der Lokomotiv’s claims for failure to fulfill such obligations, including claims in respect of fines, interest and costs, all as referred to in Article 3:92 of the Belgian Code.

The goods delivered by Der Lokomotiv that fall under the retention of title may only be resold in the context of normal business activities and may never be used as a means of payment.

The customer is not authorized to pledge the goods falling under the retention of title or to encumber them in any other way.

The customer already gives unconditional and irrevocable permission to Der Lokomotiv or a third party to be appointed by Der Lokomotiv to enter, in all cases in which Der Lokomotiv wishes to exercise its property rights, all those places where its properties will be located and those things there to bring along.

If third parties seize the goods delivered under retention of title or wish to establish or assert rights thereon, the customer is obliged to inform Der Lokomotiv as soon as may reasonably be expected.

The customer undertakes to insure and keep insured the goods delivered under retention of title against fire, explosion and water damage as well as against theft and to provide the policy of this insurance for inspection on request to Der Lokomotiv.

Right of withdrawal

if there is a consumer purchase, in accordance with the Distance Selling Act (Article 7: 5 of the Belgian Code), the customer has the right to return (a part of) the delivered goods within a period of 14 working days without giving any reason. This period starts when the ordered goods have been delivered. If the customer has not returned the delivered goods to Der Lokomotiv after this period, the purchase is a fact. Before returning, the customer is obliged to report this in writing to info@derlokomotiv.com within the period of 14 working days after delivery. The customer must prove that the delivered goods have been returned on time, for example by means of proof of postal delivery. Return of the goods must be in the original packaging (including accessories and accompanying documentation) and in new condition.

If the goods have been used, encumbered or damaged in any way by the customer, the right to dissolve within the meaning of this paragraph lapses. With due observance of the provisions in the previous sentence, Der Lokomotiv ensures that the full purchase amount, including the calculated shipping costs, will be refunded to the customer within 30 days after proper receipt of the return shipment. Returning the delivered goods is entirely at the expense and risk of the customer.

The right of withdrawal does not apply to:

Services (including events), the implementation of which, with the consent of the consumer, has started for the period of seven working days

Goods or services whose price is subject to fluctuations in the financial market, over which the supplier has no influence

Goods that are manufactured according to the consumer’s specifications, for example custom work, or that have a clearly personal character

For goods or services that cannot be returned due to their nature, for example in connection with hygiene or that can spoil or age quickly

Consumer electronics of which the consumer has broken the seal

Cycling Adventures

Social Group Rides
  • ‘Gravel & Coffee and The SWS Sweet Seasonal rides are social group ride, both to members of the group and to outsiders. Gravel paths are excellent and often busy hiking trails, where people with children and pets experience their own adventures. A group of cyclists can quickly come across as a threat, so we kindly ask you to pass serene and say Hi. This way we can ensure that these types of journeys can continue to exist.
  • Our rides are unsupported, what means there will never be a car nearby or feeding stations on the way. We will have to solve our mechanical problems ourselves. So you will have to bring and carry your own stuff, but it is still a social event, so We will help each other out.
  • We will leave no one behind.
  • Riders will be provided with a gpx file a couple of days before the event to complete the course. Bart Der Lokomotiv will be the main guide for completing the course, and may deviate from the gpx route if circumstances require.
  • Every participant declares to be the holder of a third-party civil liability insurance policy.
  • The participants should be 18 years or older. In case younger than 18 years, an approval of parents/guardian is required.
  • Our journeys continue on public roads, the road code is therefore always primary. Therefore, riders must follow the instructions of organization and law enforcement.
  • Riders bike and gear should be equipped to ride the trails of the day, (like described in the event) if it is a gravel / mtb  ride, you should be prepared for both gravel -and forest roads.
  • Wearing a bicycle helmet is mandatory during our rides.
  • We will respect nature and only dump litter in foreseen places (bins).
  • You as a rider are responsible for your own actions. Der Lokomotiv, Cycling Adventures or its guides cannot be held liable/responsible for any accidents or costs arising due to an accident before, during or after the ride.
  • A medical certificate or UCI licence that says you are in good health, free of conditions incompatible with the practice of amateur cycling and, therefore, able to participate in a long distance non-competitive cycling events, provided by your family doctor is mandatory, if one or more countries where our bikepacking passes ask for this.
  • Der Lokomotiv, Cycling Adventures or its partners cannot be held liable/responsible for any damage or loss of personnel possessions before, during or after the ride.
  • As a participant you agree that Der Lokomotiv, Cycling Adventures, can freely use photos, videos and recordings made during the event. As participant at our events you agree that we can and will use and publish content of these photos, videos and recordings for promotion purposes on all kind of (social) media. 
  • As a participant you may apply a 100 % refund within 14 days after complete registration. When refunds occur a 5 Euro administration cost will be charged. After 14 days it is possible to hand over the ticket to another participant, but Der Lokomotiv should be notified with all details of the new participant as registration and agreement on terms and regulations are on name.
  • In case of force majeure the event can be cancelled to ensure riders safety. In this case no refund will be applicable, but we will . But we will do our best to give you a good and fair compensation.
Bikepacking Adventures
  • Our bikepacking adventures are challenges against yourself, even if you have a tracker that shows you and our supporters your position in the event. There is no prize money to be won, so it is not a race.
  • Our rides are unsupported, what means there will never be a car nearby or feeding stations on the way. We will have to solve our mechanical problems ourselves. You will have to bring and carry your own stuff.
  • The use of outside support from third parties is not permitted in any way whatsoever.
  • Drafting is prohibited. Exception registered pairs.
  • Riders will be provided with a gpx file a month before the event to complete the course. 
  • Riders must complete the designated route from start to finish under their own power
  • The GPX file is mandatory you can leave the track to search a sleepingplace or a needed shop, but you have to pick in again on the same place.
  • Every participant declares to be the holder of a third-party civil liability insurance policy.
  • The participants must be 18 years or older.
  • Our journeys continue on public roads, the highway code is therefore always primary. Therefore, riders must follow the instructions of the organization and law enforcement.
  • Riders bike and gear should be equipped to ride the trails of the day, (like described in the event) if it is a gravel / mtb  ride, you should be prepared for both gravel -and forest roads.
  • The bike must be equipped with a bel, lights and reflective strips (in addition, riders need to have a spare set of lights with them at all time) 
  • Wearing a bicycle helmet is mandatory during our rides.
  • All riders need to have a reflective vest with them all time
  • A first aid kit is mandatory
  • We will respect nature and only dump litter in foreseen places (bins).
  • You as a rider are responsible for your own actions. Der Lokomotiv, Cycling Adventures or its staff members cannot be held liable/responsible for any accidents or costs arising due to an accident before, during or after the ride.
  • Der Lokomotiv, Cycling Adventures or its partners cannot be held liable/responsible for any damage or loss of personnel possessions before, during or after the ride.
  • As a participant you agree that Der Lokomotiv, Cycling Adventures, can freely use photos, videos and recordings made during the event. As participant at our events you agree that we can and will use and publish content of these photos, videos and recordings for promotion purposes on all kind of (social) media. 
  • As a participant you may apply a 100 % refund within 14 days after complete registration. When refunds occur a 10 Euro administration cost will be charged. After 14 days it is possible to hand over the ticket to another participant, but Der Lokomotiv should be notified with all details of the new participant as registration and agreement on terms and regulations are on name.
  • In case of force majeure the event can be cancelled to ensure riders safety. In this case no refund will be applicable, but we will . But we will do our best to give you a good and fair compensation.

What do we sell?

Der Lokomotiv, cycling Adventures is primarily an event organizer specializing in social rides, gravel & bikepacking adventures. We also have podcast and YouTube episodes on these topics.

In these episodes we regularly talk about interesting products and accessories for our sport. If we like these products we will not only review them. But if possible, we will also sell them directly to you. We would like to offer you the widest possible range of products for gravelbikers & bikepackers. In addition, we are happy to offer you the products of our event partners and our event merchendising designed by Bart Der Lokomotiv.

Our stock professes
Within our webshop we would like to offer a wide and as complete range of products for gravel bikers and bike packers. But as a small start-up webshop, we have a very limited own stock. Our stock will grow systematically, based on what you buy, and will be visible in our webshop at all times. Together with our suppliers we keep this information as current as possible. However, it may happen that after your order has been received, a color, size or the entire item is temporarily out of stock. We will notify you as soon as possible by e-mail about the delivery time of the order. You can then choose to wait for your order, select an alternative item or cancel your order. Changing or canceling your order is of course completely free of charge. You can even have the products from your order that are in stock delivered, of course at no extra cost.

This product is in stock at Der Lokomotiv and can be shipped next Monday, if ordered and paid before 23:00 on Sundays.

 

Next week

unfortunately this product is not in stock at Der Lokomotiv, but our supplier indicates that they do have the product in stock. When the product is received by us from our supplier. Products ordered before 5pm on Thursday will be shipped on Monday. If the delivery was not on time, we will send your order immediately after delivery.

Week 34

unfortunately this product is not in stock at Der Lokomotiv and our supplier also does not have this product in stock. Our supplier expects to deliver this product in week number and the product will be shipped to you in the same week from Der Lokomotiv.

Delivery time unknown

unfortunately this product is not in stock at Der Lokomotiv and our supplier also does not have this product in stock. Our supplier does not have a good overview of when this product will be back in stock, but does expect to receive it. If you wish, we will notify you by email if this product is back in stock.

Delivery

Delivery takes place while supplies last.

Under the rules of distance selling, Der Lokomotiv will execute orders at least within 30 days. If this is not possible (because the order is not in stock or is no longer available), or there is a delay for other reasons, or an order can not or only partially be executed, the consumer will receive within 1 month after placing the order message and in that case he has the right to cancel the order without costs and notice of default.

The delivery obligation of Der Lokomotiv will be fulfilled, subject to proof to the contrary, as soon as the goods delivered by us have been offered to the customer once. In case of home delivery, the report of the carrier, containing the refusal of acceptance, serves as full proof of the offer of delivery. Der Lokomotiv is not liable for delays, loss or damage due to the transport company.

All terms mentioned on the website are indicative. No rights can therefore be derived from the aforementioned periods.

Warranty 

Warranty period

Der Lokomotiv offers on all articles at least the legal warranty, if applicable extended with better warranty conditions that the manufacturer offers you.  The warranty period is always stated in the product details or in the documentation that you receive with your order.

When can you claim under warranty?

You can claim warranty if the defect is due to a material or construction fault. In consultation with the manufacturer / supplier, we opt for repair or replacement of the defective part or article. Damage due to improper use is not covered by the warranty scheme.

If the purchase fails within 30 days of receipt, you will be eligible for the 30-day warranty, whereby the item can be exchanged or the purchase can be canceled.

How do you apply for warranty?

Is there unexpectedly something wrong with the item you purchased? If that is the case within the valid warranty period, we would like to solve it for you as soon as possible! You can easily request a warranty by sending an email to info@derlokomotiv.com stating your invoice number and a description of the problem, if possible supplemented with clear photos. We will contact you as soon as possible about further processing.

Exporting products
When you export a product to countries outside the EU, you can claim a refund of the paid VAT. However, it is not possible for us to deliver the VAT refund forms and related administration automatically or digital. Therefore, we can not comply with any requests of repayment of the paid VAT.
Intra-Community Supply
On all of our orders the mandatory VAT is applied. It is not possible to deliver products by means of an Intra-Community supply. This means it is not possible to deliver our products free of VAT. An exception to this are team building events and events organized at the request of a company.
Second chance

What is a Second Chance product?

Perhaps we can make you happy with an attractive discount on our Second Chance product!

A Second Chance product is an item that is returned or exchanged by a customer. Products used by us for testing and reviews will sometimes also be available as Second chance product.  Of course we have carefully checked for you whether the product still functions properly and whether there is any damage. In the product description of Second Chance products you will clearly see the condition of the product.

How does ordering a Second Chance product work?
Ordering a Second Chance product actually works the same as placing an order for a new product. You can clearly see in the title and description of the article that it is a Second Chance. Once you have decided to purchase the item, simply place it in your shopping cart
